These Terms of Service ("Terms") govern your use of the Kai Calls website and services ("Service"). By accessing or using our Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By using Kai Calls, you agree to comply with and be bound by these Terms and all applicable laws and regulations.
2. Use of Service
- You must be at least 18 years old or have legal capacity to use the Service.
- You agree to provide accurate information and not use the Service for unlawful purposes.
- We may suspend or terminate your access at any time for violation of these Terms.
3. User Responsibilities
- Maintain the confidentiality of your account credentials.
- Do not misuse, disrupt, or attempt to gain unauthorized access to the Service or other users' data.
- You are responsible for all activity under your account.
4. Intellectual Property
All content, trademarks, and intellectual property on the Service are owned by Kai Calls or its licensors. You may not copy, modify, or distribute any content without permission.
5. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee the Service will be error-free, secure, or uninterrupted.
6. Limitation of Liability
To the fullest extent permitted by law, Kai Calls is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
7. Termination
We may terminate or suspend your access to the Service at any time, with or without notice, for any reason.
8. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes means you accept the new Terms.
10. Subscription and Billing
- Billing Cycle: Subscriptions are billed on a monthly basis unless otherwise specified. Usage-based charges are calculated per second of AI call time.
- Payment: Payment is due at the beginning of each billing cycle. We accept major credit cards and other payment methods as displayed at checkout.
- Overages: If you exceed your plan's included minutes, you will be charged at the overage rate specified in your plan.
- Refunds: We offer refunds within 30 days of initial purchase if you are not satisfied with the Service. After 30 days, refunds are provided at our discretion.
- Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period.
11. AI Voice Services
- Call Recording: By using our AI voice services, you acknowledge that calls may be recorded for quality assurance and training purposes.
- Consent: You are responsible for ensuring that your callers are informed and consent to interacting with an AI assistant and being recorded, as required by applicable laws.
- Accuracy: AI responses are generated based on the information and training provided. We do not guarantee 100% accuracy of AI responses.
- Limitations: Our AI assistants should not be used for emergency services, medical advice, legal advice, or other critical decisions without human oversight.
12. SMS & Text Messaging
By opting in to receive SMS messages from KaiCalls, you agree to the following terms:
- Consent: You consent to receive SMS messages by checking the SMS consent checkbox on our web forms, by providing verbal consent during a recorded call with our AI assistants, or by initiating a text conversation with us. Consent is not a condition of purchasing any service.
- Message Types: You may receive missed call notifications, appointment confirmations and reminders, follow-up messages related to your inquiries, and customer care messages.
- Message Frequency: Message frequency varies based on your interactions. Typically 1–5 messages per month.
- Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation message and no further texts will be sent unless you opt in again. Reply HELP for assistance.
- Costs: Standard message and data rates from your mobile carrier may apply. KaiCalls does not charge fees for SMS messages.
- Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier.
- Third-Party Provider: SMS messages are transmitted via Twilio, Inc. By opting in, you acknowledge that your phone number and message content will be processed by Twilio to deliver messages on our behalf.
- Privacy: Your phone number and SMS consent data are handled in accordance with our Privacy Policy and SMS Consent & Messaging Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
- Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier.
13. Third-Party Integrations (Google, CRM, etc.)
Kai Calls integrates with third-party services to provide scheduling, email, and CRM features. By connecting a third-party account:
- Authorization: You authorize Kai Calls to access and use data from connected services (e.g., Google Calendar, Gmail) as described in our Privacy Policy.
- Google APIs: Our use of Google data complies with the Google API Services User Data Policy, including the Limited Use requirements. We only access the specific Google services you explicitly connect.
- Revocation: You may disconnect any third-party integration at any time from your dashboard Settings. Disconnecting stops all data access and removes cached data from our systems.
- Third-Party Terms: Your use of connected services remains subject to that service's own terms and privacy policies. We are not responsible for the availability, security, or policies of third-party services.
- AI Agent Actions: When you connect Google Calendar, our AI agents may create, modify, or cancel calendar events on your behalf during phone calls. You are responsible for reviewing appointments created by the AI agent.
14. Service Level
We strive to maintain 99.9% uptime for our services. In the event of downtime:
- We will work to restore service as quickly as possible.
- We are not liable for any damages resulting from service interruptions.
- Scheduled maintenance will be communicated in advance when possible.
